Terms & Conditions of use of the test

This is a courtesy translation. The Italian version of these Terms & Conditions is the only legally binding one; in the event of any discrepancy, the Italian text prevails.

In short: the test provides guidance suggestions free of charge and for informational purposes only. It is neither a psychological diagnosis nor professional advice of any kind. The results are purely indicative and are in no way binding on the user's educational or career choices.

Art. 1 — Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

  • «Platform»: the Orientamento Superiori website available at orientamentosuperiori.it and all its connected subdomains.
  • «Service»: the online guidance test made available by the Platform, including its processing algorithms and the generated reporting.
  • «Test»: the structured multiple-choice questionnaire that the User completes in order to receive guidance suggestions.
  • «Result» or «Report»: the output processed automatically by the algorithm on the basis of the answers provided by the User, indicating the types of upper secondary schools potentially best suited to the detected profile.
  • «User»: any natural person who accesses the Platform and uses the Service.
  • «Operator»: the party that provides the Service and manages the Platform.

Art. 2 — Object and purpose of the Service

The Service consists of a guidance test that is exclusively informational and educational in nature, designed to help students and families explore possible upper secondary school options based on interests, aptitudes, grades and personal preferences declared by the User.

The Result produced by the Service:

  • does not constitute a psychological or psychodiagnostic diagnosis, nor any activity reserved to psychologists under Italian Law No. 56 of 18 February 1989;
  • does not constitute professional advice of a medical, psychological, educational, legal or any other nature;
  • does not constitute a certified aptitude assessment nor a binding opinion on educational or career choices;
  • does not guarantee the User's suitability for a specific course of study or career;
  • is produced automatically by an algorithm and by artificial intelligence (AI) systems, and is not prepared by professionals nor individually reviewed by experts.

The final choice of educational path remains the sole responsibility of the User, of the parents or guardians (for minors) and of any school guidance professionals consulted.

The textual explanations and personalized suggestions contained in the Report are generated by artificial intelligence (AI) systems based on the User's anonymous answers. Such content is produced automatically, is not subject to individual human editorial review before publication, and may contain inaccuracies or errors. Pursuant to Art. 50 of EU Regulation 2024/1689 (AI Act), the User is clearly and distinguishably informed that the personalized content of the Result is artificially generated.

Art. 3 — Limitation of liability

The Service is provided free of charge, on an as-is basis, without any warranty of accuracy, completeness or fitness for specific purposes.

To the extent permitted by applicable law, the Operator shall not be liable for:

  • the educational or career choices made by the User on the basis of the Result, even if such choices should prove inadequate or unsatisfactory;
  • direct, indirect, incidental or consequential damages arising from the use of, or inability to use, the Service;
  • errors, inaccuracies or omissions contained in the Result, arising from the automatic nature of the algorithmic and artificial intelligence processing;
  • interruptions of the Service due to maintenance, technical failures or force majeure.

Note: these limitations of liability do not exclude or limit the Operator's liability in cases where the law does not allow it, including cases of wilful misconduct, gross negligence or infringement of the consumer's inalienable rights under Italian Legislative Decree No. 206 of 6 September 2005 (Consumer Code).

Art. 4 — Minors and parental responsibility

The Service is intended mainly for lower secondary school students. For Users under the age of 14, pursuant to Art. 8 of EU Regulation 2016/679 (GDPR) and Art. 2-quinquies of Italian Legislative Decree No. 196 of 30 June 2003 (Privacy Code), as amended by Legislative Decree No. 101/2018, the processing of personal data is lawful only with the express consent of the parents or of those exercising parental responsibility.

For minors of any age, the Operator recommends that the Test be taken in the presence of a parent, guardian or teacher, who can support the student in understanding the Result and in the final choice.

The parent or guardian who assists a minor in using the Service accepts these Terms also in the name and on behalf of the minor and assumes full responsibility for such acceptance.

Art. 5 — Processing of personal data

The processing of personal data collected through the Service is governed by the Orientamento Superiori Privacy Policy, which forms an integral part of these Terms & Conditions and must be read together with them.

The data entered in the Test is processed in anonymous or pseudonymized form and used solely to generate the Result and, in aggregated and anonymous form, to improve the Service. No individual data is transferred to third parties for marketing or commercial profiling purposes.

Art. 6 — Intellectual property

All content on the Platform — including, by way of example, texts, graphics, algorithms, source code, trademarks and logos — is the exclusive property of the Operator or its licensors and is protected by Italian Law No. 633 of 22 April 1941 on copyright and by applicable intellectual property regulations.

Any reproduction, distribution, modification or commercial use of the Platform's content without the Operator's prior written consent is prohibited.

Art. 7 — Changes to the Terms & Conditions

The Operator reserves the right to amend these Terms & Conditions at any time, publishing the updated version on the Platform with the date of the last change. Continued use of the Service after the changes are published constitutes acceptance of them.

Art. 8 — Applicable law and jurisdiction

These Terms & Conditions are governed by Italian law. For Users acting as consumers under Italian Legislative Decree No. 206 of 6 September 2005, any dispute shall be subject to the exclusive jurisdiction of the court of the place of residence or elected domicile of the consumer User, pursuant to Art. 33(2)(u) of the same decree.

For Users acting outside a consumer relationship, the competent court is that of the place where the Operator has its registered office.
